This Privacy Policy describes how Soulution Holdings LLC ("Morphe," "we," "us," or "our") collects, uses, stores, and protects your information when you use the Morphe mobile application and related services (the "App"). Morphe is a biometric self-transformation tool that measures physiological signals to provide personalized wellness practices. Because we handle sensitive biometric and health-related data, we have written this policy to be as clear and transparent as possible. Please read it carefully.
By using the App, you agree to the collection and use of information in accordance with this Policy. If you do not agree, please do not use the App.
1. Important Notice About Wellness Use
Morphe is a wellness and self-development tool. It is NOT a medical device, and it does not diagnose, treat, cure, or prevent any disease or medical condition. The biometric readings provided by the App (including heart rate, heart rate variability, stress index, and respiration rate) are estimates intended for general wellness and informational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider regarding any health concerns. Never disregard professional medical advice because of something you read or measured in the App.
2. Information We Collect
2.1 Biometric & Physiological Data
The App uses your device's front-facing camera together with remote photoplethysmography (rPPG) technology to estimate physiological signals. This processing analyzes subtle color changes in your skin to derive:
- Heart rate
- Heart rate variability (HRV)
- Stress index
- Respiration rate
2.2 Self-Reported Wellness Data
Through the Daily Alignment Tracker and related features, you may voluntarily provide information about your nutrition, exercise type and duration, sleep timing and duration, and meditation or spiritual practice. You may also provide optional intake information such as your name and, if you choose, birth data used to personalize practices.
2.3 Account & Contact Information
When you create an account, we collect your email address and authentication identifiers (including, if you use Sign in with Apple, the identifier Apple provides). We do not receive your Apple ID password.
2.4 Subscription & Transaction Data
Purchases are processed by Apple through the App Store. We do not collect or store your payment card details. We receive confirmation of your subscription status and related transaction identifiers from Apple to manage your access.
2.5 Device & Usage Data
We automatically collect limited technical information such as device model, operating system version, app version, crash reports, and anonymized usage analytics (for example, which features are used and session frequency). This helps us maintain stability, improve performance, and develop new features.
3. How We Use Your Information
We use the information that we collect for the following purposes:
- Provide the core App experience: process scans, classify your state, and deliver personalized protocols
- Generate your history, progress trends, and before/after results
- Personalize practice recommendations using your biometric and self-reported data
- Operate, maintain, secure, and improve the App
- Process and manage your subscription and account
- Communicate with you about updates, support, and service-related matters
- Comply with legal obligations and enforce our terms
We do not sell your personal information. We do not sell, rent, or share your biometric data with advertisers or data brokers. We do not use your biometric data for advertising purposes.
4. AI Processing
To interpret your state and generate personalized protocols, the App transmits your numerical biometric readings and relevant self-reported data to our secure backend and to third-party large language model (LLM) providers that perform inference on our behalf. This data is transmitted securely and is used solely to generate your results. We instruct our processors not to use your data to train their models, and we transmit only the data necessary to produce a recommendation. We do not transmit facial imagery or video.
5. How We Share Information
We share information only in the limited circumstances below:
- Service providers: cloud hosting, database, analytics, crash reporting, and AI inference providers who process data on our behalf under confidentiality and data-protection obligations
- Apple: for authentication and subscription processing
- Legal and safety: when required by law, subpoena, or to protect the rights, property, or safety of users or the public
- Business transfers: in connection with a merger, acquisition, or sale of assets, subject to the protections of this Policy
We never share your biometric data for any third party's independent marketing or advertising purposes.
6. Data Storage, Security & Retention
We use industry-standard safeguards including encryption in transit (TLS) and encryption at rest, access controls, and secure infrastructure to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
We retain your data for as long as your account is active or as needed to provide the App. You may request deletion of your account and associated data at any time (see Section 8). We will delete or anonymize your data within a commercially reasonable period following a verified deletion request, except where retention is required by law.
7. Biometric Privacy Rights (BIPA & Similar Laws)
Certain jurisdictions, including Illinois under the Biometric Information Privacy Act (BIPA), and Texas and Washington under their respective laws, provide specific protections for biometric data. Where these laws apply:
- We obtain your consent before collecting biometric identifiers or biometric information
- We use this data solely to provide the App's functionality as described in this Policy
- We do not sell, lease, trade, or profit from your biometric data
- We retain biometric data only as long as needed to provide the service and delete it in accordance with our retention practices and applicable law
By creating an account and enabling the scan feature, you provide your informed consent to the collection and processing of your physiological data as described in this Policy. You may withdraw consent at any time by disabling the feature and deleting your account.
8. Your Rights & Choices
Depending on your location, you may have rights to access, correct, delete, or port your personal information, to object to or restrict certain processing, and to withdraw consent. Specifically, you are able to do the following:
- Access and update your profile information within the App
- Request a copy of your data
- Delete your account and associated data through the App settings or by contacting us
- Disable camera access at any time through your device settings (note this disables the scan feature)
- Opt out of non-essential analytics where offered
California residents (under the CCPA/CPRA) and residents of the EU/UK (under the GDPR) have additional rights and may be entitled to lodge a complaint with a supervisory authority. We do not discriminate against users for exercising their privacy rights. To exercise any right, contact us using the details in Section 12.
9. Children's Privacy
The App is not intended for, and may not be used by, anyone under the age of 18. We do not knowingly collect personal or biometric information from minors. If we learn that we have collected such information from a person under 18, we will delete it promptly. If you believe a minor has provided us information, please contact us.
10. International Users
We are based in the United States, and your information may be processed and stored in the United States or other countries where our service providers operate. These jurisdictions may have data-protection laws that differ from those in your country. Where required, we implement appropriate safeguards for international transfers.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated Policy in the App and updating the "Last updated" date, and where required by law, by obtaining your consent. Your continued use of the App after changes take effect constitutes acceptance of the updated Policy.
